Search Benton County Probate Records

Benton Small Estate Records
Oregon allows an abbreviated small-estate process through an affidavit of claiming successor. Benton County's probate page states that this process may be used if personal property is no more than $75,000, real property is no more than $200,000, and the total aggregate estate is no more than $275,000. The court page cautions that those limits were accurate as of April 2016 and can change, so a current filing should verify the present limits before relying on them.
Small-estate records may still become court records because the affidavit process is filed with the court. The record may show the decedent, claiming successor, estate asset categories, notices, and related court events. It is not the same as a full probate estate with every possible estate administration step, but it can still be the court record that clears title or supports distribution when the estate fits the statutory limit.

Benton Probate Record Contents
A public Benton County probate record may show the case number, court, filing date, party names, case type, docket or register events, notices, hearings, orders, judgments, and copy-request path. OJD explains that a case register is a log of events. It is not the document file itself. A public search result may confirm that a probate case exists and show basic events, but it may not supply a will, inventory, order, exhibit, or transcript. Certified or complete document access must go through the court copy process when the record is public and the document is copyable.

Restricted Benton Probate Records
Probate is often public in basic estate matters, but guardianship and conservatorship records can involve sensitive medical, capacity, financial, or family facts. Probate Records vs Bankruptcy
Probate records and bankruptcy records are not the same thing.
